The Temporary Suspension of Dr. John Joseph Brennan’s authorization to treat injured workers, announced by Board Subject Number 046-788 dated July 24, 2015, is hereby RESCINDED.

The Board’s action is founded on the Order to Show Cause signed by Schenectady County Supreme Court Justice, Vincent J. Reilly, Jr. on August 3, 2015 in Matter of Brennan v New York State Workers’ Compensation Board (Index No. 2015-1985). The Order to Show Cause temporarily restrains and enjoins the Workers’ Compensation Board from suspending Dr. Brennan’s authority to treat workers’ compensation claimants until further notice.

The Medical Director’s Office will immediately reinstate Dr. Brennan to the list of providers authorized to treat injured workers. The Board will revisit Dr. Brennan’s authorization status upon conclusion of the aforementioned CPLR Article 78 proceeding.
