Subject Numbers Regarding Health Provider Authorizations

Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised her authority to temporarily suspend Dr. Vinson M. Di Santo's authorization to perform independent medical examinations within the New York State workers' compensation system effective May 1, 2021. Dr. Di Santo's last known business address is:

The Chair's designee's investigation has revealed that the New York State Department of Health, State Board for Professional Medical Conduct (BPMC) issued Order # 21-077 imposing limitations upon Dr. Di Santo's medical practice and placing him on probation for thirty-six months arising out of disciplinary action taken by another state, which, if committed in New York State, would constitute professional misconduct under the laws of New York State.

Therefore, the Chair believes that Dr. Di Santo may be guilty of misconduct as described in Education Law §6520(4) and/or (6), and/or 6530(3), and 6530(9)(d), and that such misconduct would detrimentally affect the quality of care provided to injured workers.

Dr. Di Santo is prohibited from performing independent medical examinations, and from conducting reviews of records regarding variance requests pursuant to 12 NYCRR § 324.3(b)(2)(ii)(a), while his authorization is temporarily suspended. Reports submitted by Dr. Di Santo for services rendered prior to May 1, 2021 are valid but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Di Santo for services rendered prior to May 1, 2021, should not be denied due to the suspension of his authorization.
