Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised his authority to temporarily suspend Dr. Stephen J. Marks’ authorization to treat injured workers within the New York State workers’ compensation system effective May 4, 2017. Dr. Marks’ last known business address is 19 Bradhurst Avenue, Suite 2850, Hawthorne, New York 10532.
The Chair’s designee’s investigation has revealed that the New York State Department of Health, State Board for Professional Medical Conduct (BPMC) has issued Order # 17-129, wherein Dr. Marks agreed not to contest the allegations, including that on or about December 4, 2013, he was convicted of driving while intoxicated in violation of section 1192(2) of the New York State Vehicle and Traffic Law, a misdemeanor; and, on or about December 16, 2016, he was convicted of operation of a motor vehicle while having over 0.08% blood alcohol content, in violation of section 1192(2) of the New York State Penal Law, a felony conviction due to his previous conviction. This resulted in a Censure and Reprimand, a $2,500.00 fine, and a sixty (60) month probationary period, during which he may practice medicine only when monitored by qualified health care professional monitors, including a Sobriety Monitor, a Practice Supervisor, and a Therapist, and that he must enroll in a Committee for Physician Health (CPH) recovery program.
Therefore, the Chair believes that Dr. Marks may be guilty of misconduct, and that such misconduct would detrimentally affect the quality of care provided to injured workers.
Dr. Marks is prohibited from rendering treatment and care to injured workers while his authorization is temporarily suspended. Reports submitted by Dr. Marks for services rendered prior to May 4, 2017, are valid, but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Marks for services rendered prior to May 4, 2017, should not be denied due to the suspension of his authorization.
This suspension remains in effect until further notice. Any questions regarding the authorized lists should be referred to the Medical Director’s Office at 1 (800) 781-2362.
