Pursuant to Workers' Compensation Law Section 13-d(4), the Chair of the New York State Workers' Compensation Board has exercised his authority to temporarily suspend Dr. Eric Johnson's authorization to treat injured workers within the New York State workers' compensation system effective May 15, 2014. Dr. Johnson's last known business address is 59 West Avenue, Brockport, NY 14420.
The Chair's designee's investigation revealed that the Department of Health, Bureau of Professional Medical Conduct (BPMC) issued BPMC Order # 13-350, wherein, Dr. Johnson did not contest the charge of having been convicted in the Naples Town Court, Ontario County, New York of driving while intoxicated, in violation of New York Vehicle and Traffic Law, Section 1192(3), a misdemeanor. Dr. Johnson was sentenced to pay $900 in fines and fees, with a one-year conditional discharge upon compliance with a six-month driver's license revocation, attendance at a victim's impact panel, and installation of an ignition interlock device. Following his conviction, the Department of Health, Bureau of Professional Medical Conduct, penalized Dr. Johnson with a censure and reprimand as well as a $1,500 fine.
Therefore, the Chair believes that Dr. Johnson may be guilty of misconduct, and that such misconduct would detrimentally affect the quality of care provided to injured workers.
Dr. Johnson is prohibited from rendering treatment and care to injured workers while his authorization is temporarily suspended. Reports submitted by Dr. Johnson for services rendered prior to May 15, 2014, are valid, but are invalid for any services rendered on or after that date. Requests to cross-examine Dr. Johnson for services rendered prior to May 15, 2014 should not be denied due to the suspension of his authorization.
